MIKE SAVAGE <br />Page 5 <br />February 16, 1981 <br />fashion attractive to other industrial users, and the establish- <br />ment of a stand of grass does not coincide with their desire. <br />Attached is a copy of the letter from the land owners on the <br />post mining land use. <br />Mike, it appears that this amendment is becoming rmre co~lex by in- <br />corporating portions of the new application into the adequacy response. <br />Therefore, I will offer the following as a means of approving part of <br />the amendment at the February Hoard Meeting and stipulating approval of <br />the remainder of the amendment to a later date. I would recommend <br />stipulating approval of the sediment crontrol so that it coincides with <br />final approval under the new state program. However, if you have concerns <br />that must be satisfied before runoff season then you should identify <br />those concerns and establish a definite date for TBM to satisfy the <br />same. In regards to the haulroad, TBM is entirely within their rights <br />to mine the area in whatever manner they chose as long as they can demon- <br />strate they will meet the performance standards. However, they will <br />not be getting into this area until September of 1981 and this gives <br />you sufficient time to review the new state program sukmittal and work <br />out the details of the road during the upcoming review. Therefore, I <br />suggest you approve the plan as sulinitted. I believe the information <br />submitted to satisfy your concerns over the loadout is adequate and <br />you can approve this portion of the amendment. <br />TBM is still anticipating that approval of the amendment will be <br />forthcoming at the February, 1981 Hoard Meeting. The above was offered <br />only as a means to minimize your review of the information presented <br />in this letter.
