Loop <br />Division Director <br />I received a telephone call today from a landowner out at the New Horizon Mine. His name is Mr. <br />Ward Burbridge. His telephone is 970-864-7408. He informed me that he would like to attend the <br />New Horizon Bond Release Inspection that has been scheduled for next month. <br />Mr. Burbridge informed me that he has a concern with the post-mining topography. He indicated <br />[hat he obtains water from a reclaimed irrigation ditch that exists near [he mine, and that before the <br />mine disturbed the ditch, he received his water by gravity flow. <br />Mr. Burbridge said that now he has to obtain his water by pumping from this ditch. He believes the <br />problem is a result of the mine reconstructing the ditch to a slightly higher topography. <br />Mr. Burbridge stated that he had raised this issue with the mine foreman, and that the foreman had <br />stated that the ditch was surveyed and found to be reclaimed as approved. It is possible, though, <br />that while the ditch radient may have been reconstructed as approved, the ditch bottom elevation <br />may be a bit too high. <br />Please telephone Mr. Burbridge at the number above, inform him as [o how he may attend the <br />inspection, and inform him that he can file written comments regazding the release request if he <br />wants to [Rule 3.03.2(3)]. Be sure to also inform Western Fuels that Mr. Burbridge may come <br />along on the inspection. Let Wes[em Fuels know that if what Mr. Burbridge says is true, one <br />possible solution could be that Western Fuels does a little regrading to lower the ditch bottom so <br />that Mr. Burbridge is able to obtain his water the way he used to. <br />Thanks, Harry. <br />Cc: Dave Berry <br />
