Pi[ (Formally !~Ieh~in Kokes Pit), Permit No. M-1978-249 <br />Corps File No. 200180766 <br />Dear Mr. Mount: <br />Reference is made to the above-mentioned project located in the W '/: of Section 34, <br />Township 12 North, Range 49 West, Logan County, Colorado. <br />This project has been reviewed in accordance with Section 404 of the Clean Water Act under <br />which the U.S. Anny Corps of Engineers regulates the discharge of dredged and CII material and any <br />excavation associated with a dredged and fill project in waters of the United States. Waters of the <br />U.S. includes ephemeral, intermittent and perennial streams and their surface connected wetlands and <br />adjacent wetlands and certain lakes, ponds, drainage ditches and irrigation ditches [hat have a nexus <br />to interstate commerce. Based on the information presented, [his project will not require a <br />Department of the Army permit. <br />Although a Department of the Army permit will not be required for this project, this does not <br />eliminate the requirements that other applicable federal, state, tribal, and local permits are obtained if <br />needed. <br />If there are any questions concerning this matter, please call 11Ir.
