<br />Mr. Lawrence G. White, P.E. -3- <br />October 28, 1994 <br />9. The TR-07 application proposes to place the 2,500 cy of material against the toe of the <br />existing bench fill. This may ultimately be acceptable; however, it must be demonstrated <br />that this available material cannot be technically or practically placed against the upper <br />highwall scarp, so as to achieve a safety factor of 1.3. It appears that some additional <br />partial elimination of the upper highwall scarp is possible using this material. Please <br />address this issue. <br />10. Please discuss the manner in which Rules 4.14.1(2)(f)(ri), (iii), and (iv) and/or <br />4.41.1(2)(g)(ii), (iii), and (iv) will be satisfied. <br />11. The TR-07 proposal indicates a small depression on the upper bench. Typically, such <br />depressions are not allowed due to geotechnical concerns. Please eliminate the depression, <br />or provide information to ensure that the underlying fill stability will not be jeopardized by <br />water retained in this depression. A'e encourage the elimination of this proposed <br />depression. <br />12. Please revise permit page 74 to eliminate the wording which indicates that the Lewis Gulch <br />fill will be permanent. <br />13. Proposed Drawing No. TP-5 indicates that the mine bench pond will be filled following <br />initial site bacld'illing. Please be aware that the pond must remain fully functional until <br />vegetation is established to Phase II bond release standards, and/or Rule 4.05.2(2). <br />14. Please revise Drawing TP-5 to eliminate this discrepancy, and to ensure that fmal back- <br />filling will eliminate the drain structure, and will eliminate any depression at the pond <br />location. <br />Road <br />1. There is conflicting information in the permit regarding the ownership and maintenance <br />status of the road to the Twin Pines No. 2 site. A letter of January 6, 1983 implies private <br />ownership, and requests restriction of public use. Recent representations indicate County <br />ownership. Please provide fomral documentation that the road is owned by the County. <br />Otherwise, the road must be permitted by the current operetor, and maintained accordingly. <br />2. It is our understanding that both the road to the mine site, and the upper road to the refuse <br />pile pre-date the currently permitted operations. Is this correct? <br />Topsoil <br />1. Please provide a revised plan which commits to the use of all available topsoil piles located <br />along the site access road. Specify available volumes, and the anticipated use of the topsoil <br />piles. <br />
