JIM TATUM
ATTORNEY AT LAW
Telephone (719) 846-0149 Facsimile (719] 846-0159
April 13, 2004
Mc David Berry
Colorado Division of Minerals & Geology
1313 Sherman Street, Room 215 RE~.+E~VE~
Denver, Colorado 80203
RE: Golden Eagle Revision APR 152004
Permit No. C-1981-013 GiVision of Minerals and Geology
Mr. Berry:
A very important factor in the revised plan is as follows:
(a) Basin claims that the airshafr has an open mesh liner with pea-gravel behind it for
the total depth of the hole.
(b) If. this mesh liner is left in place covering the water-bearing zones, it is
~', impossible for acement-grout seal to seal off the water-bearing zones; if the
" grout-cement plug cannot seal the area occupied by gravel -that is, we will have
an unsealed gravel area around the entire hole that cannot be plugged if we don't
~ insure that the grout can reach the total diameter of the bore-hole.
(c) We have experienced so much deception and dishonesty by Basin. If the mesh
liner exists, the corrections as proposed will not work. If the liner exists in the
water-bearing zones, the proposed method of sealing off the water strata will not
work. If the mesh liner does not exist in the water-bearing zones, then the
proposed plugs will work. What is the truth of the matter?
(d) Do we have any reliable hydrological data as to whether or not the depleted water
zone will be restored and/or recharged? Do w8 have any data as to length of time
it will take to recharge the zone?
Again, please do not let these lying scoundrels get by with violating the law regarding
sufficient bond.
Very truly yours,
_~ ~~
m Tatum
JT/dd "
cc: Bill Bianco, Esq. -
Davis, Graham & Stubbs LLP
1550 Seventeenth Street, Sui[e 500
Denver, CO 80202
129 North Commercial Street Trinidad, Colorado 81082
