Long <br />Denver, CO 80203 Division o~rectnr <br />Re: Colowyo Coal Mine (Permit No. C-81-019) <br />Technical Revision Application No. 47 (TR-47) <br />Reduction in the Frequency of Monitoring Revegetated Areas <br />Dear Mr. Green: <br />The Division of Minerals and Geology (Division) hereby issues notice, in accordance with Title 34, Article 33, <br />Section 1 16, Paragraph 4, of the Colorado Revised Statutes, that on March 22, 1999, an application to revise coal <br />mining operations at the Colowyo Coal Mine was considered complete for the purposes of filing. The revision was <br />submitted by Colowyo Coal Company L.P. All review and comment periods as provided in the Act and the <br />Regulations initiate from this date of filing. <br />This technical revision provides for a reduction in the monitoring of revegetated ores from the 1st, "lnd, and every <br />3rd year thereafterafter seeding Itntil bond release inspections to the l st, 2nd, and 4th year after seeding until bond <br />release inspections. <br />The surface coal mining operation is on land located approximately 23 miles south of Craig. The permit area is <br />further described as follows: <br />All or portions of Sections 2, 3, 4, 8, 9, 10, 1 I, 14, 15, 16, 17, 20, 21 and T3N, R93 W; and Sections 13, I5, 22, 23, <br />24, 26. 27, 28, 33 and 34, T4N, R93 W; 6th Prime Meridian. <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle maps of Axial & Ninemile Gap. <br />The above-referenced[echnical revision application would not incorporate additional lands into [he permit area, nor <br />does it permit the disturbance of additonal undisturbed areas. [t does alter previously approved mitigation measures. <br />In accordance with the May 1991 Memorandum of Understanding (MOU) between our agencies, we must have your <br />concurrence in order to approve this proposal. We are required to make a finding that "the proposed operations wi II <br />not adversely affect any publicly owned park or place listed on or those places eligible for listing, as determined by <br />the SHPO, on the National Register of Historic Places, unless approved jointly by the Board and the Federal, State, <br />or local agency withjurisdic[ion over [I3e park or place." Therefore, we request that you submit comments regarding <br />your concurrence with, concerns with, or objections to this proposal. In order that we may comply with regulatory <br />time frames, we request that comments be submitted within fifteen (I ~) days of this letter.
