Please clarify the acreage specifically reclaimed to industriaUcommercial use and <br />explain how the primary post-mining land use will be industrial/commercial with a 136 acre <br />groundwater fed lake. <br />13. Please clarify the acreages of various land uses when the site is fully reclaimed, ie: water and <br />shoreline acreage, industriaUcommercial acreage, topsoiled and revegetated acreage, etc. <br />14. The applicant has proposed a topsoil replacement depth of 6". Correspondence from the <br />original permit application indicates that topsoil averages approximately 12" across the permit <br />area. Since approximately 74% of the affected land will be reclaimed to water surface and there <br />is an average of 12" of salvageable topsoil, there should be an abundance of topsoil available for <br />the disturbed acreage to be topsoiled and revegetated, ie: enough to supply a replacement depth <br />of 12, 18, or 24". In order to improve the potential for revegetation success on these azeas, the <br />Division recommends that VCI substantially increase the topsoil replacement depth for acreage <br />(approximately 81.35 acres) to be revegetated. Please respond. <br />15. A copy of July 10, 2003 correspondence from William H. Fronczak of the Office of the State <br />Engineer to Cheryl Signs indicates that VCI has assumed conditions of a lined pond. The <br />applicant's Exhibit E -Reclamation Plan does not include any provisions for a lined pond. <br />Please clarify whether the 7 acre and 125 acre reclaimed lakes will be lined or unlined as a par[ of <br />final reclamation. (The conditions specified in the applicant's mining and reclamation plan need <br />to be consistent with the conditions specified in the applicant's applications for required water <br />pernuts from the Office of the State Engineer). <br />16. Please provide an approvable Flood Control/Mitigation Plan for the Durham Pit acceptable to <br />Weld County, US Army Corps of Engineers, and FEMA. Such plan may include plans, designs, <br />and elevations for any flood control berm and/or spillways to remain during final reclamation. <br />17. The approved (original) reclamation plan specifies plantings of Russian Olive, Sunburst <br />Locust, and American Plumb in groups of 3 to 5 and appropriate spacing for future growth. <br />Please indicate whether these specifications will be incorporated into the Amendment application <br />or whether they should be deleted from the reclamation plan and why. Please respond. <br />18. Please indicate whether VCI will continue to maintain and commit to a 100 foot buffer <br />between the reclaimed pond edge and the top of bank for the Cache La Poudre river. <br />6.4.6 EXHBIT F -Reclamation Plan Maa <br />19. The elevations noted on the Exhibit F -Reclamation Plan Map aze not readable. Please <br />provide a reclamation plan map with cleaz and readable elevations and/or contours. <br />
