Long
Division Director
Re: Request for a Reduction of the Financial Warranty, Coaldale Quarry, M-1977-247
Dear Mr. Klco:
Pursuant to Rule 4.16.1(2), the operator shall provide a copy of the reduction of the warranty
amount to the county and to the owner of the affected land and provide the Division with proof
of such notice prior to approval of the bond reduction. Proof of notice shall be in the form of
either (a) a return receipt of a certified mailing, or (b) a signed and dated hand delivery receipt or
shipping bill.
If the operator and the landowner are the same, there is no need to notify the landowner.
I hope to have the financial warranty requirement re-calculated by the end of next week (11-17-
00) but will not be able to approve the reduction (if one is warranted) until I receive the proof of
notice to the county (and landowner if not the same as the operator).
If you have any questions, please give me a call.
Sincerely,
i
James Dillie
Environmental Protection Specialist
STATE OF COLORADO
cc: Thomas Brooks, G-P
James Stevens, DMG
