The pond design and certification show that the <br />side slopes of the pond provide safe and adequate access for the proposed <br />uses. Examination of the Discharge Monitoring Reports (DMR's) and the <br />Quarterly Pond Inspections show that the level of water is sufficiently <br />stable for the intended use and the size of Pond A is adequate for its <br />intended purpose. The DMR's also show that the quality of water is adequate <br />for the intended use. The TDS is well below the maximum recommended level <br />for cattle of 5000 mg/l. CMLRD's recent findings document for renewal of <br />permit C-81-071 found that the increased TDS would not be significant enough <br />to cause material damage. "Pond A waters will not be discharged for <br />irrigation purposes in areas above the confluence of Middle Creek and Trout <br />Creek until that time when the operator proves that no material damage will <br />occur from flood irrigation, and the operator also proves that the water is <br />sufficiently diluted, prior to entering any irrigation system, to meet the <br />2,000 mg/1 (total dissolved solids) use criterion for irrigation waters; <br />unless, this use criterion is changed and the operator shows that the new <br />standard is met." Pond A is suitable and in harmony with the approved <br />• postmine landuses. The postmine landuses are rangeland, pastureland and <br />cropland. These uses imply livestock grazing, wildlife use and irrigation <br />for production of crops such as hay, which relates directly to the approved <br />uses for the decreed water rights. CYCC will be able to take advantage of <br />the irrigation rights because they control most of the storage and ditch <br />rights along Foidel, Middle, Fish and Trout Creeks (as~noted ire previously <br />referenced findings document). The water is also very important to CYCC's <br />livestock operation. Upon final reclamation CYCC will have 3500 acres or <br />more of reclaimed land and 2500 acres of other associated land (aspen, mtn. <br />shrub, sagebrush, etc.) in the Mine 1 and Eckman Park area.
