Mr. Dale Moore, a private landowner on the site, prepared a <br />letter dated 2/18/91 which documented his lack of interest in sagebrush <br />re-establishment. The Division received the letter on March 6, 1991. <br />Stipulation 30 was derived from Minor Revision 3, the 1990 Mid-Term. The <br />Division had requested that Wyoming Fuels re-work the surface drainage plan, <br />and the operator asked if the Division could delay their request until the <br />Phase II Bond Release decision was made. During the evaluation of Phase II <br />Bond Release submittal materials, the Division made findings on October 5, <br />1990, that erosion from the disturbed area was not detrimental to the <br />post-mining land use, and that the disturbed area ceased to contribute to <br />additional suspeded solids above natural conditions. Thus, a surface drainage <br />plan was not necessary. <br />Stipulation 29 specified the water monitoring requirements for the site. <br />Technical Revision 4 limited water monitoring into a single water level <br />measurement in well 7, the spoils well, each year, as noted on page 71 of the <br />permit.
