Mr. Dale Moore, a private landowner on the site, prepared a
letter dated 2/18/91 which documented his lack of interest in sagebrush
re-establishment. The Division received the letter on March 6, 1991.
Stipulation 30 was derived from Minor Revision 3, the 1990 Mid-Term. The
Division had requested that Wyoming Fuels re-work the surface drainage plan,
and the operator asked if the Division could delay their request until the
Phase II Bond Release decision was made. During the evaluation of Phase II
Bond Release submittal materials, the Division made findings on October 5,
1990, that erosion from the disturbed area was not detrimental to the
post-mining land use, and that the disturbed area ceased to contribute to
additional suspeded solids above natural conditions. Thus, a surface drainage
plan was not necessary.
Stipulation 29 specified the water monitoring requirements for the site.
Technical Revision 4 limited water monitoring into a single water level
measurement in well 7, the spoils well, each year, as noted on page 71 of the
permit. TR 4 was approved 10/5/90. Thus Stipulation 29 is obsolete.
If you have any questions on this review please feel free to call me.
Si ncere/l~y, ,,
~ l~~
Catherine W.
