The applicant proposes to excavate two surface runoff erosion control containment
structures of 0.104 acre-feet and 0.085 acre-feet capacity. These structures will be adjacent
to the Middle Fork of the Purgatoire River.
As long as outlet works aze included which allow detained water to be drained, or the
detained water will infiltrate into the ground within a few days, we see no problems with
the proposal. If, however, there will be water detained in the structures for more than a
few days, replacement water will have to be made available to the river to make up for
that amount evaporated from the ponds. Such replacement will have to be through either
a plan for augmentation approved by the Water Court or a substitute water supply plan
approved by this office.
Please contact this office or our Division 2 office in Pueblo at (719) 542-3368 if you have
further questions.
KVH/clf:newelk

cc: Steve Witte, Division Engineer
Danny Mazques, Water Commissioner
