III IIIIIIIIIIIIIIII
999
DEPARTMENT OF NATURAL RESOURCES
David H. Ge[ches, Ezecuhve Director
MINED LAND RECLAMATION DIVISION
DAVID C~SHELTON, Director
Richard D. Lamm
Governor
May 30, 1985
Mr. Steven Self
Eastside Coal Company
P.O. Box 161
Silt, Colorado 81652
Dear Mr. Self:
On May 20, 1985 the Division received the above-referenced technical revision
request (dated May 16, 1985). Our initial review indicates that this
application is complete for the purpose of filing on this date. All review
and comment periods as provided in the Act and the Regulations promulgated
thereunder initiate from this date of filing.
I have enclosed a public notice for the revision. You should commence
publication of this notice as specified under Rule 2.08.4(5)(b)(c).
Based on our review to date, the Division intends to approve the incidental
permit boundary change and the construction of the rip-rapped channel as
specified in drawing 3. However, based on the stream buffer zone variance
granted by the Division which requires restoration of the stream channel
(Rule 4.05.18(1)) and the apparent post mining topography, the Division does
not feel that sufficient evidence has been presented by the applicant for the
need to leave the rip-rapped channel in place as apart of final reclamation.
Eastside Coal Company may have to submit additional data in support of the
proposed reclamation plan before the Division could give final approval.
If you have any questions, please contact me at the Division.
Sincerely,
~./ .,
Jeff Deckler
Reclamation Specialist
JD/nsh
Enclosure(s)
1030E
423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
