We will be submitting a modification to change tine post <br />mining land use and release the old office site from the permit area in the near fuhire. \Ve <br />concur with your understanding of how this issue will be handled in the permit modification <br />process. However, we are concerned with your request for water samples from the on-site wells. <br />Approved TR-003 acknowledged that the site had been properly detoxified and that the Division <br />allowed BMRl to remove all heap leach material and backfill the ponds. Therefore, TR-003 <br />released BMRI from all responsibilities of cyanide use at the old office site. In addition, we <br />have no baseline data on these wells and they have not been sampled for at least 6 years. Before <br />agreeing to sampling, BMRI needs to understand the need for sampling, "the use of the sample <br />data, what standards will be applied, and how these standards will be applied without baseline <br />data. <br />F. Magnesiwn Chloride CV-l. Based on your letter the Magnesium Chloride :.ituation <br />has been resolved. <br />We hope that this provides additional clarification of alt matters of concern in a timeframe for a <br />resolution.
