III. COMMENTS -COMPLIANCE Below are comments on the inspection. The comments include discussion of observations made during the inspection. Comments also describe any enforcement actions taken during the inspection and the facts or evidence supporting the enforcement action. The purpose of this inspection was to evaluate the field portion of Trapper's Phase 1 and Phase 2 bond release submittal. Representing the state were Joe Dudash, David Berry and Bill Carter. Forrest Luke represented the operator. Mitch Rollings provided oversite for OSM. Janet Hook represented the BLM. The Phase 1 bond release request encompasses 2583.7 acres. The Phase 2 bond release request covers 1570.5 acres. These areas are located in the Ashmore, Colt/Browning, Derringer, and Enfield pits. The entire bond release inspection lasted from Monday, November 4, 1996 through Wednesday, November 6, 1996. The weather was cool and clear on Monday. It started to snow on Tuesday. Wednesday was cold but clear again. Trapper submitted the Phase 1 and Phase 2 bond release package on September 9, 1996. The public notice, which announced this bond release submittal, was published for four consecutive weeks, from September 6, 1996 through September 27, 1996. Trapper sent out letters, informing of the bond release submittal, to the landowners within the permit area and adjacent area and to the appropriate agencies. There were no comments from the public, or from the landowners and agencies involved. betters, announcing this inspection, were sent to the only two landowners within the permit area, the state and Trapper. OSM and BLM were also informed of this inspection. The Division will conduct a follow up inspection if there are any field problems that need to be resolved. The Division will continue to evaluate the contents of the Phase 1 and Phase 2 submittals in order to identify any remaining adequacy concerns. After all of the adequacy concerns have been resolved, the Division will issue a proposed decision and findings document. PHASE 1 BOND RELEABE Trapper's Phase 1 portion of the bond release submittal included as-built post-mining topography maps, certified representative cross-sections which show the as-built topography and the approved post-mining topography, and drainage profiles showing as-built versus the approved profiles. Trapper also submitted a summary of their erosion prevention techniques and supplied references to the permit application concerning the designs of the approved sediment control system and documentation of the compliance history of those structures. 1
