III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />The purpose of this inspection was to evaluate the field portion of <br />Trapper's Phase 1 and Phase 2 bond release submittal. Representing <br />the state were Joe Dudash, David Berry and Bill Carter. Forrest <br />Luke represented the operator. Mitch Rollings provided oversite for <br />OSM. Janet Hook represented the BLM. The Phase 1 bond release <br />request encompasses 2583.7 acres. The Phase 2 bond release request <br />covers 1570.5 acres. These areas are located in the Ashmore, <br />Colt/Browning, Derringer, and Enfield pits. The entire bond release <br />inspection lasted from Monday, November 4, 1996 through Wednesday, <br />November 6, 1996. The weather was cool and clear on Monday. It <br />started to snow on Tuesday. Wednesday was cold but clear again. <br />Trapper submitted the Phase 1 and Phase 2 bond release package on <br />September 9, 1996. The public notice, which announced this bond <br />release submittal, was published for four consecutive weeks, from <br />September 6, 1996 through September 27, 1996. Trapper sent out <br />letters, informing of the bond release submittal, to the landowners <br />within the permit area and adjacent area and to the appropriate <br />agencies. There were no comments from the public, or from the <br />landowners and agencies involved. betters, announcing this <br />inspection, were sent to the only two landowners within the permit <br />area, the state and Trapper. OSM and BLM were also informed of this <br />inspection. <br />The Division will conduct a follow up inspection if there are any <br />field problems that need to be resolved. The Division will continue <br />to evaluate the contents of the Phase 1 and Phase 2 submittals in <br />order to identify any remaining adequacy concerns. After all of the <br />adequacy concerns have been resolved, the Division will issue a <br />proposed decision and findings document. <br />PHASE 1 BOND RELEABE <br />Trapper's Phase 1 portion of the bond release submittal included <br />as-built post-mining topography maps, certified representative <br />cross-sections which show the as-built topography and the approved <br />post-mining topography, and drainage profiles showing as-built <br />versus the approved profiles. Trapper also submitted a summary of <br />their erosion prevention techniques and supplied references to the <br />permit application concerning the designs of the approved sediment <br />control system and documentation of the compliance history of those <br />structures. <br />1 <br />
