The Phase I bond application is incorporated into by reference into this Phase [I bond release. The Phase [bond release discusses other reclamation standards and ho~v the reclamation met those standards. All of the runoff water from the disturbed area is directed through the Sediment Pond SP 1. There is no indication of sediment being deposited in the sediment pond since the mine water has not been discharged into the pond. A survey of the pond site was conducted February 3, 2001, to determine if the volume of the pond had decreased due to sediment being deposited. A previous survey .vas completed in 1995 for the final post mining topography map. A comparison between the two surveys indicates that no sediment has been deposited in the sediment pond. A copy of the pond survey are enclosed. This demonstrates that the vegetation cover is adequate to prevent erosion of the reclaimed lands. The drainage ditch over the edge of the embankment to the bottom of Harvey Gap has been riprapped to prevent erosion if any water is discharged from the area above the reclaimed area or from the reclaimed area. Upon approval of the Phase I[ bond release the collection ditch and the diversion ditch will be filled in and the drainage across the reclaimed area south of the portals will be diverted into this channel. Also the sediment pond will be reclaimed upon the Phase II bond release approval.
