NOTICE OF PROPOSED DECISION <br />The Colorado Division of Minerals and Geology proposes to Approve with conditions Technical <br />Revision Application No. 55 (TR-55) for the Colowyo Coal Mine (Pemut No. C-1981-019), submitted by <br />Colowyo Coal Company L.P.. This proposed technical revision to Permit C-81-019 waives (under the <br />provisions of Rule 4.05.9(18)) the requirement (Rule 4.05.9(17)) to perform quarterly inspections of <br />certain impoundments (stock ponds) on reclaimed azeas of the mine. The requirement (Rule 4.05.9(14) to <br />accomplish annual inspections of these ponds remains in effect. <br />The Colowyo Coal Mine is a/an Surface coal mine located in Moffat County, approximately 28 miles S of <br />Craig. Coal interest is Federal, and the surface affected is Federal, state and private land. The pemut azea <br />encompasses approximately 7,402.50 acres. <br />This proposed decision is based on a finding that the proposed operation will comply with all <br />requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101, et seq., C.R.S., <br />and the regulations promulgated thereunder. <br />Copies of the ptoposed decision, including stipulations, are on file For public inspection at the Colorado <br />Division of Minerals and Geology, Room 2I5, Centennial Building, 1313 Sherman Street, Denver, <br />Colorado 80203. Persons with an interest that may be adversely affected by the proposed decision may <br />request a formal hearing before the Mined Land Reclamation Boazd on the proposed decision. Such <br />request must be made within ten (10) days of the initial publication of this notice, must be in writing, and <br />must state with reasonable specificity the reasons for the request and the objections to the proposed <br />decision. <br />
