_~~ ;^3~ <br />The Prehearing Conference Officer recommends that the following proposed <br />issues not be heard, as they~are outside the authority of the Board to act on: <br />a. General air quality concerns. <br />b. Truck traffic. <br />c. Aesthetic effects, effects on scenery or view from highway. <br />IV. WITNESSES <br />The applicant will call Mr. McGehee. <br />Mr. Shain will testify in person. <br />To the extent that any party wishes to call any other witnesses at the hearing, <br />the following procedures will apply. If anyone fails to comply with such procedures, <br />the Prehearing Conference Officer recommends that any witnesses offered not be <br />heard, absent good cause shown for the failure. <br />Proce ure: Each parry shall provide written notice of the following to, (1) each <br />other party; and l2) Mr. Oswald, at the Division of Minerals and Geology, no later <br />then 5:00 p.m. on Thursday, January 19, 1995. The notice must be in writing and <br />must contain: <br />a. Name of witness. <br />b. Witness' address and telephone number (if knownl. <br />c. Brief description of subject matter of testimony. <br />V. EXHIBITS <br />Any party may use any document submitted as part of the Applicant's <br />application as an exhibit at hearing. No other documents should be admitted, absent <br />good cause, unless the party offering the document complies with this procedure. <br />Procedure: Each party shall provide legible copies of each exhibit to be offered <br />to; 111 each other. party; and (2) Mr. Oswald, at the Division of Minerals and Geology, <br />no later than 5:00 p.m. on Thursday, January 19, 1995. If exhibits are voluminous, <br />and cannot be conveniently delivered or faxed, Mr. ~Oswald's copy may be mailed <br />provided it is postmarked no later than January 19. All other parties must receive <br />physical copies of exhibits by the deadline. <br />3 <br />
