Copies of the current NPDES permit and the permit renewal application aze <br />enclosed for inclusion in Exhibit 22. Please remove the old permit from Exhibit <br />22. <br />2. Page 2.05-19 has been revised. NECC commits to sampling the dischazge mine <br />water at the pump-head and obtaining sample data documenting compliance prior <br />to beginning discharge into the Purgatoire River. The Division will be provided <br />with the analytical data. <br />3. Coal processing waste and coal stockpile debris will be disposed of at the <br />Development Waste Pile. This material will not be used in embankment <br />construction (Page 2.05-19). <br />4. A copy of the proposed emergency spillway design is attached.
