This plan is valid through April 30.2005, unless othervrise revoked or modified. <br />y. This substitute water supply p;an may be revoked or modified at any time should it <br />be determined that injury to other vested water rights has or will occur as a result of <br />this plan. <br />10. !f this plan is not approved as an augmentation plan by the Water Court prior to the <br />expiration date, a renewal request must be submitted >n this office with the <br />statutory fee (currently $21?) at least 45 days prior to ttie expiration date of this <br />plan. <br />11. Should this substitute water supply plan expire without renewal or be revoked prior <br />to adjudication of a permanent plan for augmentation, any new excavation of <br />product from below the water tatrle and ali other use of-water at the pit must cease <br />immediately. <br />12. This office must receive a copy of the $743,000 bond before mining commences. <br />13. In accordance with amendments to §25-8-202(7), C.R.S., and Senate Bill 89-181 <br />Rules and Regulations adopted on February 4, 1992, t7e State Engineer shall <br />determine if the substitute supply is of a quality to meet requirements of use to <br />which the senior appropriation receiving the substituted supply has normally been <br />put. As such, water quality data or analyses may be requested at any time to <br />determine if the requirements of use of the senior appropriator are met. <br />19. If reclamation of the mine site will produce a permanent water surface exposing <br />groundwater to evaporation, an application for a plan fnr augmentation must be <br />filed with the Division t Water Court at least three (3) years prior to the completion, <br />of mining to include, but not be limited to, tong-term evaporation losses. If a fined <br />pond results after reclamation, replacement of lagged depletions shall continue <br />until there is nv longer an effect on stream flow. <br />15. Acceptance of these conditions is assumed unless this office, the Division <br />Engineer, and the Water Commissioner, to the contrary receives a letter within two <br />weeks after receipt of this letter. <br />
