-21- <br />The reader is referred to that Findings Document for details of the above <br />conclusions. Proposed changes in the operation since the original permit <br />issuance all involve the lessening of potential impacts to these alluvial <br />valley floors. These changes include: <br />Smaller permit area, including loss of coal underlying South Canyon <br />Creek; <br />only minimum (15,000 yd3) disposal of coal mine waste on the <br />surface; <br />lower maximum permitted coal production, implying less attendant <br />surface activity. <br />The Division finds, based on its previous assessments and written Findings, <br />that the proposed operation will not interrupt, discontinue or preclude <br />farming on alluvial valley floors, will not materially damage the quantity or <br />quality of water in surface or ground water systems that supply the alluvial <br />valley floors, and will be conducted to preserve the essential hydrologic <br />functions of the alluvial valley floors. <br />The proposed operation is in compliance with the requirements of this section. <br />Climatological Information and Air Resources - <br />Rules 2.04.8,2.05.4{20(h). 2.05.6(1) and 4.17 <br />These topics are addressed in Section 3.4 of the Permit Revision application. <br />The relevant Colorado Department of Health Air Quality Permits for the mine <br />site are current. <br />The proposed operation is in compliance with the requirements of this section. <br />XI. Topsoil - Rules 2.04.9. 2.05.3(5). 2.05.4(2)(d). and 4.06 <br />Baseline soils information is located in Section 3.5 of the application. The <br />soils on the site are considered fair to good growth media. Approximately <br />63,000 cubic yards of topsoil have been salvaged from the disturbed areas, <br />sufficient to cover the disturbed area with an average of approximately 13 <br />inches of topsail. The applicant has committed in the reclamation plan to <br />replacing 16 inches of topsoil on the disturbed areas. Due to the apparent <br />shortage of topsoil material in relation to the replacement thickness <br />committed to, the following Stipulation is imposed. <br />STIPULATION N0. 18 <br />WITHIN 180 DAYS OF PERMIT ISSUANCE, THE APPLICANT SHALL RESURVEY ALL <br />EXISTING TOPSOIL STOCKPILES, AND DETERMINE WHETHER A 16 INCH REPLACEMENT <br />DEPTH IS POSSIBLE. IF IT IS DETERMINED NOT TO BE POSSIBLE, THE <br />RECLAMATION PLAN SHALL BE MODIFIED ACCORDINGLY. <br />
