o is
•r Notice of Proposed Decision
The Colorado Division of Minerals and Geology has issued a proposed decision to approve Bond
Release Application No. 2 (SL-2) for the Colowyo Coal Mine, Permit No. C-81-019. The mine is
operated by Colowyo Coal Company L. P. under the provisions of the Colorado Surface Coal Mining
Reclamation Act of 1979. The bond release application was submitted by Colowyo Coal Company
L.P. on September 25, 1997. This application, titled 1997 Phase I Bond Release, 1987-1995
Reclaimed Areas, is for release of reclamation liability for reclamation work accomplished only, not
a return of bond monies. The work accomplished was backfilling, grading, establishing of drainage,
and placing of topsoil over 712.1 acres of ground disturbed during mining activities. The affected
area is located in Moffat County, approximately 28 miles South of Craig.
Notice of this proposed decision was published in the Craig Daily Press on May 6, 1998. However,
a correction has been made to page 18 of the Proposed Decision and Findings of Compliance.
Specifically, a part of line 10 of page 18 is changed from "there were adverse effects" to read "there
were no adverse effects".
Copies of the proposed decision, with the changed page 18, are available for review at the Colorado
Division of Minerals and Geology office, 1313 Sherman Street, Room 215, Denver, Colorado
80203, and at the office of the Moffat County Clerk and Recorder.
Any person who has an interest which is or may be adversely affected may request an adjudicatory
hearing regarding this proposed decision. Requests for a hearing must be made in writing within
thirty (30) days of the first publication of this notice (advising of the changed page 18), and shall
state with reasonable specificity the reasons for the request and objections to the proposed decision.
r
