NOTICE OF PROPOSED DECISION <br />The Colorado Division of Minerals and Geology proposes to Approve Technical Revision Application No. <br />47 (TR-47) for the Seneca II-W Mine (Permit No. C-1982-057), submitted by Seneca Coal Company. This <br />revision was submitted to abate Notice of Violation (NOV) CV-2003-015. The revision will allow for <br />modification of certain aspects of the aspen study plan, including the schedule of work and the plot layout. <br />The Seneca II-W Mine is a surface coal mine located in Routt County, approximately 9 miles south of <br />Hayden. Coal interest is Federal, and the surface affected is Federal, state and private land. The permit azea <br />encompasses approximately 4,093.00 acres. <br />This proposed decision is based on a finding that the proposed operation will comply with all requirements <br />of the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101, et seq., C.R.S., and the <br />regulations promulgated thereunder. <br />Copies of the proposed decision, including stipulations, aze on file for public inspection at the Colorado <br />Division of Minerals & Geology, 101 South 3rd, Suite 301, Grand Junction, Colorado 81501 and at the <br />Division of Minerals and Geology, Room 215, Centennial Building, 1313 Sherman Street, Denver, Colorado <br />80203. Persons with an interest that may be adversely affected by the proposed decision may request a <br />formal hearing before the Mined Land Reclamation Boazd on the proposed decision. Such request must be <br />made within ten (10) days of the initial publication of this notice, must be in writing, and must state with <br />reasonable specificity the reasons for the request and the objections to the proposed decision. <br />
