Cattany <br /> Division Director <br />Re: Keenesburg Mine, C-1981-028, SL-03 Adequacy 2 Natural Resource Trustee <br />Dear Mr. Savage: <br />Coors Energy Company submitted a request for a phase II bond release on July 5,2005. The application was deemed <br />complete on September 27, 2005. A bond release inspection was conducted on October 6, 2005. The Division sent an <br />adequacy letter on November 3, 2005 requesting additional information on two items. <br />On November 22, 2005, Savage and Savage Environmental provided a response to the Division's adequacy concern <br />No. 2. The sedimentology demonstration was submitted (via fax) to the Division on November 22, 2005. As required <br />by Rule 3.03.1(3)(6), the sedimentology demonstration compared the reclaimed areas to an adjacent non-mined area <br />using the LISLE formula. LISLE is an acceptable means for comparison. Afrer reviewing the sedimentology <br />demonstration, the Division has one additional question. <br />The statement is made on page 3 of the application that the reclaimed and adjacent undisturbed slopes are of <br />relatively uniform slope for the areas of concern. The reclaimed areas have an averaged slope of 1.5% and <br />length of 570 feet, yet the non-mined comparison area has a slope of 3.5% and a length of 742 feet. The <br />Osgood Sand reference area is flat. <br />Please submit a map showing the transects used to determine slopes of 2 degrees (3.5%) and slope lengths of <br />742 feet on adjacent non-mined areas. <br />On November 30, 2005, the Division received three copies of revised Appendix L-5, Vegetation/Re-vegetation map. <br />Appendix L-5 has been revised to show a 0.5-acre area removed from the Area 24 parcel as requested by the Division. <br />The 0.5-acre area in question has been incorporated into the Long Term Spoil Area. This revision to the map is <br />acceptable and resolves the Division's adequacy concern No. 1. <br />The application continues to be under evaluation. The Division will make a decision on the proposed release after <br />CEC submits the requested information. In a letter to the Division, dated August 9, 2005, you requested a meeting <br />with the Division regarding the reclamation liability amount eligible for this Phase II bond release.
