The Flood Control Mitigation Plans provided aze deemed "draft plans" as they will still <br />be subject to review and approval by Weld County and FEMA. Please indicate whether <br />the operator Varna Companies, Inc. (VCI) would prefer to a) commit to providing final <br />designs and specifications, and reclamation costs following approval from Weld County <br />and FEMA, or b) leaving the review of this revision request "open" until such time that <br />the necessary approvals from Weld County and FEMA are secured. In order to leave this <br />revision request "open", VCI will need to waive their right to a decision within 30 days. <br />Please respond. <br />Refer to VCI correspondence of 25 Apri12005 pertaining to VCI waiving its right to a review <br />decision within 30 days (previously submitted). <br />2. Please affirm that the FCMP assures that any potential for adverse offsite impacts to <br />adjacent landowners on either side of the Cache La Poudre River during future flooding <br />events have been minimized. <br />Mitigation of impacts to adjacent landowners is the detailed intent of the designed FCMP <br />engineered by Anderson CE. We believe a more technical answer beyond that evidenced by the <br />diverse studies, maps and accumulated engineering performed by Anderson CE, and submitted to <br />DMG for examination, is best addressed by Anderson CE should the Division's concerns be <br />more specific. <br />3. Please indicate whether the anticipated water surface elevation fora 10-year, 25-year, 50- <br />yeaz, or 100-yeaz flooding event will exceed the north bank elevation for the Anderson <br />Salvage or Bliss Produce property to the north. If so, please estimate the depth and <br />velocity of flood waters encroaching onto the Anderson and/or Bliss property. <br />Per Anderson Consulting Engineers, Inc., FEMA requires the delineation of the 100-year and <br />500-year floodplains as shown on Sheets 1 thru 4 of the hydraulics study. Therefore, the extent <br />of the 10-,25 -, and 50-yeaz events has not been delineated. However, the 10-yeaz event is <br />considered the "bank full" event and is typically contained within the active channel banks. <br />Sheet 4 documents the extent of the 100 year floodplain in the revised (with project) condition. <br />Sheet 4 indicates that the 100-year flood will be out of the active/main channel in several <br />locations along the north bank. Velocities and depths in the north overbank azeas during the <br />100-yeaz flood will be slow moving and generally less than 2 feet deep respectively. <br />4. As previously provided during the Amendment No. 1 application review, Varna <br />Companies, Inc. has committed to complete reclamation of the flood control berm within <br />90 days of approval from appropriate regulatory agencies and to provide the Division <br />with a set of"As Built" construction designs within 30 days of the completed berm <br />reclamation. The "As Build designs will also need to be signed and certified by a <br />registered professional engineer with experience in floodplain and floodway hydraulics. <br />The certification will need to assure that the flood control structure has been constructed <br />according to the design specifications.
