<br /> <br />Introduction <br />This document is the findings of compliance and proposed decision of the Colorado <br />Division of Minerals and Geology (the Division) in response to a request for a Phase 1 <br />and Phase II Bond Release at [he Marc Mine and Loadout, Division petmi[ number <br />C-80-006. This document contains four parts: 1) procedures and summary of the bond <br />release process; 2) criteria and schedule for bond release; 3) observations and findings of <br />the Division regarding compliance with the bond release requirements of the Colorado <br />Surface Coal Mining Reclamation Act (the Act) and [he Regulations promulgated <br />thereunder; and 4) the Division's proposed decision for the bond release request. <br />Detailed information about the review process can be found in the Act and the Rules and <br />Regulations of the Colorado Mined Land Reclamation Board for Coal Mining (Rules). <br />All sections referenced in this document are contained in the Rules. Detailed information <br />about the mining and reclamation operations of the Marr Mine can be found in the permit <br />application on file at the Division Offices, located a[ 1313 Sherman Street, Room 215, <br />Denver. CO 80203. <br />The Marr Mine is a reclaimed surface mine that is permitted and operated by the Kerr <br />Coal Company (KCC). The ownership of the land for which bond release has been <br />requested is both Federal and private. <br />Marr Mine SL-02 <br />
