Long <br />Divivon Duecmr <br />DMG has received your request for extension of the decision due date and extension of the <br />public comment period for the Tozer Pit amendment application, AM-01. Per your request, <br />the public comment period has been extended to September 18, 1998. <br />Rule 1.4.5(3), requires that for applications where timely objections have been submitted, <br />the decision date shall not be less than thirty (30) days after the last day of the public <br />comment period. On August 3, 1998, DMG received objection to the Tozer Pit amendment <br />application, submitted by Eric Lindgren, Therefore, DMG decision date has been extended <br />to October 19, 1998, which is thirty-one 131) days after the last day of the public <br />comment period. <br />ADEQUACY REVIEW <br />DMG review of the amendment application has identified adequacy issues. Please be <br />advised that the amendment application for the Tozer Pit, may be deemed inadequate and <br />may be denied on October 19, 1998, unless the following adequacy review items are <br />addressed to DMG's satisfaction. <br />Proof of Publication: Please submit proof of publication and proof of all required notices, <br />as required by Rules 1.6.2(1)Ig) and 1.6.2(1)(cl, (d), (e) and (f). <br />DMG has received proof of notice, mailed 8/4/98, to the following landowners: Pick & <br />Shovel Ranch, Barry & Shirley Wiseman, Jeff Olson (BLM), Elanor Tozer, Eric & Kim <br />Lindgren, Ute Mountain Ute, and BOC Group, Inc. <br />
