Douchane <br />Vice President, North American Operations <br />Battle Mountain Resources, Inc. <br />5670 Greenwood Plaza Blvd., Suite 106 <br />Englewood, Colorado 80111 <br />Re: Response to Third Round of Technical Adequacy Comments; <br />TR-010, INCO SOZ/Air Tailings Treatment Process; <br />Battle Mountain Resources, Inc.'s San Luis Project; <br />Permit No. M-81-112 <br />Dear Mr. Douchane; <br />The following regards Battle Mountain Resources, Inc.'s (BMRI's) <br />response to the Division's second round technical adequacy comments <br />of July 27, 1992, which included adequacy comments by David Hyatt, <br />PhD., representing the Parties. <br />MLRD Comment $`1 <br />Paragraph 1 <br />In combination with BMRI's agreement to monitor the tailings <br />exiting the INCO reactor, as presented on pages 3 and 4 of BMRI's <br />July 31, 1992 response, BMRI's proposal to determine compliance of <br />the three tailings ponds using a simple 30-day average is <br />acceptable to the Division. Several additional conditions are <br />presented hereafter. The pond sampling protocol will be clearly <br />specified within the sampling and analytical protocol of TR-006. <br />Paragraph 2 <br />The simple 30-day average method for regulating compliance of the <br />three tailings ponds is acceptable to the Division. However, it is <br />not acceptable to the Division to wait until a month after the <br />close of the subject month to obtain the monitoring results. <br />Therefore, BMRI shall supplement the formal monthly sampling <br />completed in accordance with the sampling and analytical protocol <br />with weekly reports of daily on-site analyses completed by BMRI, <br />correlated with twice monthly laboratory analyses. In addition, <br />BMRI shall report any analyses determined to be in excess of the <br />permit standards to the Division immediately. <br />• <br />STATE OF COLO~O <br />
