Banta. <br />Division Drtector <br />With this notification the Colorado Mined Land Reclamation Division proposes to approve <br />a name change to permit No. C-80-007 formerly known as West Elk Coal Company, Mt. <br />Gunnison No. 1 Mine to be changed to Mountain Coal Company, West Elk Mine. Both <br />companies are wholly owned subsidiaries of the Atlantic Richfield Company. The name <br />change was processed as a succession of operators. <br />The mine area is located in Sections 9, 10, 15 to 22, 26 to 30 and 34, Township 13 South, <br />Range 90 West, of the 6th P.M.; containing 4,240 acres. This area is located on the USGS <br />7.5 minute Somerset quadrangle topographic map. <br />Pursuant to Rule 2.08.6(4) the Division finds that: <br />1. the applicant is eligible to receive a permit in accordance with Rule 2.07.6(1)(b), <br />(c) and (2). <br />2. the applicant has submitted a bond rider that will change the company and mine <br />name on the performance bond. <br />3. the applicant will conduct the operations involved in full compliance with the <br />terms and conditions of the original permit, and in accordance with the requirements <br />of the Act and these rules. <br />Pursuant to Rule 2.08.6(6), the issuance of this notice will initiate a 30 day public comment <br />period. Any person with an interest which is or may be adversely affected may request a <br />format public hearing on the decision by the Division. Requests for a hearing must be made <br />in writing within thirty (30) days of this notification and shall state with reasonable <br />specificity the reasons for the request and objections to the decision. <br />If you have any questions please feel free to call me. <br />Sincerely, , ?
