Walther Executive Direcor Michael 8. long Division Director The Division of Minerals and Geology hereby issues notice, in accordance withl'itle 34, Article 33, Section 116, Paragraph 4, of the Colorado Revised Statutes, that on February 18, 1999, an application to revise coal mining operationsattheBowieNo.2Minewasconsideredcompletefortheputposesoffiling. The revisionwnsubmitted by Bowie Resources Limited. All review and comment periods as provided in the Act and the Regulations initiate from this date of filing. Approval of this technical revision would allow mining in the west section of the already approved permit area. Mining would remain conventional room and pillarand th:re would not be any increase in the production rate. No Federal coal is involved. In addition, the mineplan map is being updated with this technical revision to show the current extent of mining and the proposed addition to the mine plan. Finally, the subsidence section of the permit application is being updated to include mining through the fault that will need to occur in order to access the proposed west mine section. The undergroundcoal miningoperation is on land Iocatedapproximately5 miles northeast of Paonia, Colorado. Th: permit area is further described as follows: Portions of Sections 2, 3, 4. 9, 10, I I, 14, l~, and 16, Township 13 South. Range 91 West of the 6th P.M. The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Bowie. Because the above referenced technical revision applicatia would incorporate additional lands into the permit area or might otherwise alter previously approved permit conditions or mitigation measures, we are requesting your agency's evaluation of the potential for impacts to tltreatenedor endagered species of plants or animals, or wildlife species otherwise protected by federatlaw. In order fir us to approve this revision. we are required to make a finding that "the activities would not affect the cominued existence Df endangered or threatened species otresult in the destruction or adverse modification of their critical habitats as determined under the Endangered Species Act of 1973...."
