Long. <br />Division Direnor <br />RE: Approval of Minor Revision 6; Red Canyon Mine; File No. <br />C-81-034 <br />Dear Mr. Stover; <br />The Division has reviewed your minor revision application (MR-6) <br />and proposes to approve your request to revise the Small Area <br />°:~emption (SAE) boundary to remove the reclaimed access road which <br />leads to the former site of the powder magazine. The SAES were <br />originally delineated on the map following reclamation of the site <br />since the sites were below the sediment pond. Following <br />reclamation, sedimentation control was provided by straw bales <br />dikes and the access road was lined with straw bales. <br />The Division believes this request is appropriate according to Rule <br />4.05.2(4) which states, "For the purposes of 4.05.2, "disturbed <br />area" shall not include those areas in which only diversion <br />ditches, sedimentation ponds, or roads are installed in accordance <br />with the performance standard requirements of this Rule..." <br />Sediment coming off roads does not have to drain to sediment ponds, <br />however they must contain some alternative sediment control measure <br />using the best technology currently available to prevent additional <br />contributions of suspended solids to stream flow or to runoff <br />outside the permit area (Rule 4.03.2(1)(b)). Your commitment to <br />maintain the straw bales, already in place, if erosion is occurring <br />along the access road is acceptable. <br />The revised page 105 you submitted on this date is acceptable and <br />will replace the page you submitted with the revision application. <br />The Volume 3 Zndex and map you provided with your original approval <br />are acceptable. They will replace those pages and the map <br />currently contained within the permit document, Following the ten <br />day public comment period, if there are no concerns, the decision <br />will be considered final. <br />STATE OF COLORADO <br /> <br />Please call if there are any questions. <br />
