USF&WS required Twentymile Coal Company to pay $2,102.87 to the <br />Recovery Program for this estimated 165.45 aclft water depletion. <br />In a memorandum dated August 5, 1997, (ES/OSM GJ-6-CO-97-F-014 CO/KS/NE/UT) the <br />USF&WS concurred with OSM's "may effect" determinations for the Colorado pikeminnow, <br />(Ptychoeheilus lucius ,razorback sucker (Xyrauchen texanus , boneytail (Gila ele ans ,and <br />humpback chub (Gila c2wha)due to a 134.89 ac/ft increase in water depletions for a new total <br />water depletion of 299.54 ac/ft. USF&WS required Twentymile Coal Company to pay an <br />additiona] $1,808.88 to the Recovery Program. <br />In a memorandum dated November 14, 1997, (ES/CO: OSM MS 65412 GJ) the USF&WS stated <br />it had no comments regarding Twentymine Coal Company's Permit Revision No. 4 since there <br />was no change in the previously consulted on water depletion. <br />As a part of the TR-59 permit application process Twentymile Coal Company revised their water <br />depletion estimates for the Foidel Creek mine to take into account water consumption associated <br />with [he increase in coal recovery from 10 million tons per year to 12 million tons per year, <br />changes mining operations and the operation of the new wash plant. These figures show that the average annual <br />depletion will be 285.6 ac/ft per year through the end of the mine. <br />The USF&WS has previously determined that water depletions in the Upper Colorado River <br />System are a major source of impact to the endangered fish species. Continued water <br />withdrawals have restricted the ability of the Colorado River system to produce the flow <br />
