Suite 215 <br />Denver CO 80203 <br />Dear Erica, <br />The following responses are made to your letter of February 20, 2001: <br />March 09, 2001 <br />RECEIVED <br />MAR 2 7 2001 <br />Division of Minerals and Geology <br />The notification process in underway. Copies of the certified mail receipts will be mailed to you as <br />soon as they are received. <br />2. Topsoil piles will be seeded with appropriate perennial grasses, most probably Crested <br />Wheatgrass or something similar. The NRCS will be consulted for their recommendations. Such <br />seed will be broadcast in appropriate quantities. <br />3. Quarry operations will be kept out of drainage ways, water channels and other sensitive areas, <br />except as provided for in the mining plan and where it is necessary to control sediment from <br />de-watering operations. Once operations cease and reclamation is substantially complete, all <br />sediment control devices will be removed as well. No rubble, overburden or waste material will be <br />discharged over cliffs or down steep slopes where recovery would be difficult. However, ELB <br />Stone will take no responsibility for areas in which such discharges were made pre-law. <br />4. Please refer to the attached documents from the Colorado Water court for documentation of our <br />rights to use the water from the Buster Big Spring. <br />5. All necessary permits will be acquired from the Colorado Dept. of Health and the Environment <br />for discharge of surface water from quarry pits. <br />6. Seed will be applied in PLS/acre as stipulated. <br />7. ELB Stone Inc. accepts your calculations for estimated reclamation costs of $132,600 as per the <br />document attached to your letter of Feb. 20, 2001. <br />I trust these responses will be adequate. If they are not please let me know. I will be in Colorado <br />through the 14'", but I will be on the Western Slope through next Tuesday.
