Banta. <br />Division Director <br />We have discussed deficiencies in the existing sediment control system several <br />times, and after some consideration, we agreed that modification of the plan <br />could be incorporated into the permit renewal. These concerns were derived <br />from review of Maps 16a and 37a, and from observations during inspections. <br />a. The temporary post-mining ditch, B-2, would be more realistically <br />and appropriately shown on Map 37a, rather than 16a. Please lay <br />out its location so it does not flow uphill. Our transfer of the <br />ditch to the post-mining map shows it going uphill in its terminal <br />700' and for approximately 500' in its northernmost loop. <br />b. Please replace the ditches along the roads on Map 16a. <br />c. Currently no ditches are shown on Map 16a along the southern permit <br />boundary to prevent water from draining into the tributary of <br />Bolton Draw prior to treatment in Pond A. If there are no drainage <br />structures here, make the appropriate demonstration for a small <br />area exemption per Rule 4.05.2(3). <br />d. There needs to be a culvert to carry water from the east side of <br />the 720 overburden stockpile into Pond B across the pond A access <br />road. This road is used frequently enough that Kerr should utilize <br />best management practices to minimize disturbances to the <br />hydrologic balance by installing a culvert. Please design an <br />appropriately sized culvert and submit a schedule for its <br />installation. In conjunction with this drainage calculation, <br />design a ditch to carry the water in a non-erosive manner to Pond D. <br />e. Please document the drainage system on the shop fill area on Nep <br />16A and prepare designs if needed. <br />
