LOr~ <br />Divhon OirKlo. <br />1) Are you proposing to revise your currently approved grading plan by eliminating the <br />regairemen[ to backgrade the existing terraced azea.(as currently required)? In other words, <br />do you propose to leave the terraced area as it curtcnt]y exists today (with the outside berm <br />and the intcmal gentle slopes and the collection areas)? <br />2) If the proposal is approved by the DMG, you will still be required to place topsoil (growth <br />mediums) over the entire disturbed area, including the terraced area end the outslopes. Jn <br />addi[ion, as it is approved, the topsoil will be impozted to the site. During our December <br />11, 2001 meeting, you presrnted a packet which contained a "Contract" from Lowry <br />Contracting, lnc. stating a price o£ $25,690 to deliver the topsoil to the mine site. The <br />DMG's estimate to deliver 4,033 cubic yards of topsoil was $30,248 (see November lb, <br />1998 Cost Summary Form)-The DMG agreed to accept the "Contract" price from Lowry <br />Contracting to determine a revised financial warranty requiroment upon approval of this <br />technical revision submittal. Since the Lowry "Contract" expires on October 2, 2002, the <br />financial werranry will be re-evaluated is late October -early November, 2002. <br />3) Just so it is very clear, the only change in the reclntrtation plan you are proposing is the <br />requirement to backgrade the terraced material. All other aspects of the approved permit <br />remain the same. <br />4) As a clarification, please confirtu that the slope gradients arc tither 3:1 or 10:1 (horizontal: <br />vertical). You show one slope in the middle of the terrace as having a gradient of 6" to <br />10'-0". If [his is incorrect, please revise, and resubmit, the map to show an accurate grade. <br />5) You aze correct when you state that the revised reclamation plan applies only to d,e <br />existing disturbance and thaz, if additional disturbance is contemplated to the east <br />(additional mining of the bighwall), you will notify the AMC with a technical revision <br />submittal prior to advancing the mined highwell(so the financial warranty requirement <br />[tray be re-evaluated). <br />
