Staff has determined that the request is
inadequate for the following reasons:
Rule 4.13.13) requires that a reduction of a warranty amount must follow the same Rules
set forth in 4.16.
Rule 4.16 requires the reduction request includes:
1) The names, address and phone numbers of all owners of record of the affected land.
2) The request shall be sent by certified mail and separate from all other
correspondence.
3) Such notice shall contain a signed statement by the operator or their agent that all
applicable portions of the Reclamation Plan requirements have been satisfied in
accordance with these Rules and all applicable requirements under the Act.
Field Office Staff would also advise Cotter that such requests are better sent to the
Denver Office first. The request can be entered into the DMG data system first and then
forwarded on to the appropriate specialist in the field. By sending the request to the Field
Office, it must be processed here, and then sent on to Denver and then back again.
