Box 2049 Eaecunve Director <br /> Broomfield, CO 80038-2049 Michael R.Wng <br /> Divrsmn Director <br /> RE: Proposed test-storage of coal fly ash, Varra Pit No. 1, Permit M-1974-052. <br /> Dear Mr. Varra, <br /> The Division of Minerals and Geology wishes to determine the status of Varra Company's proposed plans <br /> to conduct tests on storage of coal fly ash at the above-captioned operation. Recent conversations suggest <br /> that Varra Companies is pursuing approval from Weld County for this activity, and that CDPHE may <br /> have already approved of the activity. <br /> While it appears that fly ash disposal has not yet begun, the status of the proposed testing and DMG's <br /> potential involvement in the testing are not evident. As you are aware, DMG has not provided approval <br /> to conduct fly ash leach testing within the area covered by MLRB Permit number M-1974-052. In fact, <br /> Varra Company withdrew Technical Revision No. 2, which requested approval of pilot testing placement <br /> of fly ash in the alluvial material of St. Vrain Creek, on August 3, 1999. <br /> If Varra intends to go forward with coal fly ash storage testing in a DMG permit area,the operator has <br /> two options: <br /> 1) The operator would remove areas that could be potentially affected by the fly ash disposal. These <br /> areas would be taken out of the reclamation jurisdiction of DMG and placed under the regulatory <br /> authority of whatever agencies might approve of the test (this would include groundwater that is <br /> downgradient of the potential disposal area). <br /> 2) The operator would modify the permit through the appropriate revision process to allow for the fly <br /> ash disposal activity. <br /> Please respond to me or to Harry Posey (303-866-3927) at your earliest convenience. <br /> S' erely, <br /> Carl B.
