L' <br />SEP 271 <br />L'a~cs!un L`I hlu:,,,_,,,„G.eOiuyY <br />Enclosed with this transmittal letter are Energy Fuels Mining Company (EFMC) <br />responses to Stipulation No. 12 in accordance with your letter dated August 23, 1994. <br />Compliance for Stipulation No. 12 included submittal of post-mining land use comments from <br />the Santa Fe Railway Company and any state or local govemment agencies having land-use <br />jurisdiction for the Raton Creek Mine. <br />EFMC has received landowner comments from the Santa Fe Railway Company and <br />has contacted the local govemment agency in Las Animas County. One copy of the signed <br />letter from Santa Fe is attached for your files. In addition, EFMC has contacted Mr. Mike <br />Ossola, Las Animas County Planner, to discuss proposed post-mining land use for the mine <br />site and loadout. According to Rule 2.05.5(1)(6), any govemment agency comments would <br />concern their intention to "initiate, implement, approve, or authorize the proposed use of the <br />land following reclamation". Mr. Ossola acknowledged that the proposed land-use for the <br />mine (rangeland) and for the loadout (industrial) were consistent with the uses designated by <br />the Las Animas Planning Department. There are no plans to change or alter the land use at <br />this time. Based on these facts, EFMC asserts that no comments from the Las Animas County <br />Government or other agencies are required. <br />This submittal should complete compliance of Stipulation No. 12.
