<br />Mr. Joe Dudash <br />March 14, 1995 <br />Page 2 <br />5. The surface and mineral ownership maps have been updated and revised to reflett <br />current ownership. They will be included as part of the "Consolidation" TR <br />application. <br />6. HGCC is currently liable for 362 acres wi[h respect to reclamation performance. <br />The basis for that figure will be included as part of the "Consolidation" TR <br />application; it does not include the Railroad Loadout and ancillary facilities. <br />7. Potentiometric surface maps for the lower and upper coal aquifers were submitted <br />to the CMLRD in May 1981 as Exhibits 42 and 43, respectively, apparently in <br />fulfillment of a stipulation issued with the initial permit renewal in January 1981. <br />A discussion of aquifers underlying and overlying the coal seams was included as <br />part of the 1987 permit renewal and pages 10 through 16 of [he CMLRD's <br />January 1987 Proposed Decision and Findings of Compliance also address this <br />issue. <br />8. As part of its November 14, 1986 "Operator's Response to Preliminary Adequacy <br />Review", HGCC revised Section 2.05.6(3)(b)(iv) (Protection of the Hydrologic <br />Balance) [o address possible effects of spoil spring development. Seasonal <br />variations in water quality and quantity were also evaluated and discussed in the <br />CMLRD's January 23, 1987 Proposed Decision and Finding of Compliance, <br />specifically on pages 18 through 20. In addition, Annual Reclamation Reports for <br />the years 1988 through 1994 presented water quality and quantity data with <br />notations concerning trends or significant changes. Section 2.05.6(3) of the <br />"Consolidation" TR application will briefly address variations in water quality <br />and quantity since the completion of reclamation operations. <br />9. Well yield information was provided in Table 3 of Appendix L (Volume IV) of <br />the 1977 HGCC Permit Application and evaluated by the CMLRD as part of the <br />1987 permit renewal. Pages 14 and 15 of the January 23, 1987 Proposed Decision <br />and Findings of Compliance discussed well yield information. <br />10. Aquifer characteristics, including an evaluation of ground water discharge, were <br />discussed in Appendix L (Volume V) of the 1977 Permit to Mine application. <br />Updated evaluations of ground water recharge and discharge were included in <br />HGCC's November 1986 "Operator Response to Preliminary Adequacy Review" <br />as part of the 1987 permit renewal. Pages 18 and 19 of the CMLRD's January <br />1987 Proposed Decision and Findings of Compliance discuss aquifer recharge and <br />discharge characteristics. Annual Reclamation Reports provide information on <br />approximate quantity and quality of discharge water.
