The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 116,
Paragraph 4, of the Colorado Revised Statutes, that on November 14, 2003, an application to revise coal mining
operations at the Bowie No. 2 Mine was considered complete for the purposes of filing. The revision was
submitted by Bowie Resources Limited. All review and comment periods as provided in the Act and the
Regulations initiate from this date of filing.
In Technical Revision No. 30, Bowie Resources Limited (BRL) is proposing to constmct a coal mine waste
disposal site. This site will provide for the permanent storagerof coal waste from the preparation plant as well as
high ash coal. The new site will be located just east of the current coal mine waste disposal site and north of the
old State Highway 133. Total disturbance will be about 34 acres in size and will be within the currently approved
pern3it azea and on land owned by BRL. Runoff from this disturbed area will be treated by a new sediment pond.
After use, the disturbed azea will be reclaimed. Since portions of the proposed coal mine waste disposal site and
haul road would be within 100 feet of the outside right-of--way of old State Highway 133, the public has a right to
request a public hearing concerning those portions:
The undergotmd coal mining operation is on land located approximately 5 miles northeast of Paonia, Colorado.

Portions of Sections 2, 3, 4, 5, 8, 9, 10, 11, 14, 15, 16, and 22, Township 13 South, Range 91 West of the 6th P.M.
Portions of Sections 33 and 34, Township 12 South, Range 91 West of the 6th P.M.

Because the above referenced technical revision application would alter previously approved pemut conditions or
mitigation measures, we are requesting your agency's evaluation of the proposal. Your comments and concerns
relating to the adequacy of fish and wildlife resources information, the fish and wildlife plan, and the reclamation
plan as it relates to fish and wildlife considerations, including potential impacts to threatened or endangered
