T ~ ~ <br />Earlier in the operation, however, any cost savings pertaining to areas underwater (i.e., no revegetation) <br />are offset by 'the hefty earthmoving costs of replacing an eight-foot-thick layer of overburden. <br />The enclosed packet includes afour-page summary of the various earthmoving tasks, followed by detailed <br />cost sheets for each individual task. Please review these sheets and contact me if you have any questions <br />about them, cr any information related to reclamation already performed. Obviously, there are activities <br />you can perform to influence the total bond required for this operation, such as: mining at slope gradients <br />which are closer to final slopes, backfilling and finish grading any slopes which will not be further <br />disturbed, topsoil replacement and seeding on those areas which will not be further disturbed, etc. Please <br />provide written evidence of Division of Water Resource approval for the pond. <br />By statute the State must require sufficient bonds from all operators (CRS 34-32.5-117(4)(b)(I). <br />Additionally, a time period is assigned during which any bond increase is to be submitted. Pursuant to <br />CRS 34-32.5-117(4)(c)(II), an operator must provide the required bond increase within 60 days from the <br />date of notification. This letter is being sent via certified mail so that such date may be determined. <br />Your current bond's amount may be revised by providing a rider to it in the increased amount, if you <br />wish. If you need any new bond forms you may request them from me at the Durango office (see below) <br />or from Ms. Suzi Ericksen at our Denver office (see letterhead). I have tried to build into these figures the <br />fitture increased amount of disturbance, but which will be reclaimed according the existing plan.
