The outstanding items listed in the AVS were fees to be <br />paid by Adobe Mining Company (Adobe). Enclosed is a copy of Adobe <br />check number 53738 that paid the fees for the first four listings on <br />the system. <br />The lest five items on the listing are being protested by Adobe <br />Mining Company and should not be on the listing. The five <br />"citations" are the result of an OSM audit that was conducted this <br />fall. OSM and Adobe disagree about the inherent moisture contained <br />in coal being mined by Adobe. I have enclosed copies of two letters <br />from Adobe to OSM to verify that the audit adjustment protest has <br />been filed. Mr. Jerome A.
