CO 80203 Re: Edna Strip Mine (Permit No. C-1980-001) Permit Renewal Application No. 5 (RN-5) Dear Mr. Wolff: OLORADO I V I S I O N O F INERALS EoiocY SAFFTY•SCIENCE Bill Owens Governor Russell George Executive DIlecYOr Ronald W. carcany Division Dimclor Natural Resource Trustee The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 118, Paragraph 3, of the Colorado Revised Statutes, that on May 19, 2006, an application to renew an existing permit to conduct coal mining operations at the Edna Strip Mine was considered complete for the purposes of filing. All review and comment periods as provided in the Colorado Surface Mining Reclamation Act and the Rules initiate from this date of filing. The Pittsburg & Midway Coal Mining Co. proposes to continue surface coal mining and/or reclamation operations on land located approximately 5 miles northwest of Oak Creek, Colorado. The permit area is further described as follows: TSN, R85 W, Portions of Sections 3 1, 32 TSN, R86W, Portions of Section 36 T4N, R86W, Portions of Sections l2, 13, 14, 23, 24, 25 T4N, R85 W, Portions of Sections 7, 8, 17, 18, 19, 29, 30 The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Cow Creek, and Rattlesnake Butte. This application is for renewal of a valid existing permit. The permit is in permanent cessation. The above- referenced permit renewal application provides time for continuing reclamation activities. In accordance with the May 1991 Memorandum of Understanding (MOU) between our agencies, we ask for your concurrence in order to approve this proposal. We are required to make a finding that "the proposed operations will not adversely affect any publicly owned park or place listed on or those places eligible for listing, as determined by the SHPO, on the National Register of Historic Places, unless approved jointly by the Board and the Federal, State, or local agency with jurisdiction over the park or place." Therefore, we request that you submit comments regarding your concurrence with, concerns with, or objections to this proposal. In order that we may comply with regulatory time frames, we request that comments be submitted within thirty (30) days of this letter. Please refer to the MOU when undertaking your review.
