CO 80203 <br />Re: Edna Strip Mine (Permit No. C-1980-001) <br />Permit Renewal Application No. 5 (RN-5) <br />Dear Mr. Wolff: <br />OLORADO <br />I V I S I O N O F <br />INERALS <br />EoiocY <br />SAFFTY•SCIENCE <br />Bill Owens <br />Governor <br />Russell George <br />Executive DIlecYOr <br />Ronald W. carcany <br />Division Dimclor <br />Natural Resource Trustee <br />The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 118, <br />Paragraph 3, of the Colorado Revised Statutes, that on May 19, 2006, an application to renew an existing permit to <br />conduct coal mining operations at the Edna Strip Mine was considered complete for the purposes of filing. All <br />review and comment periods as provided in the Colorado Surface Mining Reclamation Act and the Rules initiate <br />from this date of filing. <br />The Pittsburg & Midway Coal Mining Co. proposes to continue surface coal mining and/or reclamation operations <br />on land located approximately 5 miles northwest of Oak Creek, Colorado. The permit area is further described as <br />follows: <br />TSN, R85 W, Portions of Sections 3 1, 32 <br />TSN, R86W, Portions of Section 36 <br />T4N, R86W, Portions of Sections l2, 13, 14, 23, 24, 25 <br />T4N, R85 W, Portions of Sections 7, 8, 17, 18, 19, 29, 30 <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Cow Creek, and <br />Rattlesnake Butte. <br />This application is for renewal of a valid existing permit. The permit is in permanent cessation. The above- <br />referenced permit renewal application provides time for continuing reclamation activities. <br />In accordance with the May 1991 Memorandum of Understanding (MOU) between our agencies, we ask for your <br />concurrence in order to approve this proposal. We are required to make a finding that "the proposed operations <br />will not adversely affect any publicly owned park or place listed on or those places eligible for listing, as <br />determined by the SHPO, on the National Register of Historic Places, unless approved jointly by the Board and the <br />Federal, State, or local agency with jurisdiction over the park or place." Therefore, we request that you submit <br />comments regarding your concurrence with, concerns with, or objections to this proposal.
