The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section I l8,
Paragraph 3, of the Colorado Revised Statutes, that on May 19, 2006, an application to renew an existing permit to
conduct coal mining operations at the Edna Strip Mine was considered complete for the purposes of filing. All
review and comment periods as provided in the Colorado Surface Mining Reclamation Act and the Rules initiate
from this date of filing.
The Pittsburg & Midway Coal Mining Co. proposes to continue Surface coal mining and/or reclamation operations
on land located approximately 5 miles Northwest of Oak Creek, Colorado. The permit area is further described as
follows:
TSN, R85 W, Portions of Sections 3 t, 32
TSN, R86W, Portions of Section 36
T4N, R86W, Portions of Sections 12, 13, 14, 23, 24, 25
T4N, R85 W, Portions of Sections 7, 8, 17, 18, 19, 29, 30
The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Cow Creek, and
Rattlesnake Butte.
This application is for renewal of a valid existing permit.
The permit is in permanent cessation. The renewal is for continued reclamation. There is no disturbance proposed
for undisturbed, or reclaimed, lands.
However, we are requesting your agency's evaluation of the potential for impacts to threatened or endangered
species of plants or animals, or wildlife species otherwise protected by federal law. In order for us to approve this
renewal, we are required to make a finding that "the activities would not affect the continued existence of
endangered or threatened species or result in the destruction or adverse modification of their critical habitats as
determined under the Endangered Species Act of 1973...." We request your review and recommendation
pursuant to this finding. As the renewal is for continued reclamation with no additional surface or underground
