All <br />review and comment periods as provided in the Colorado Surface Mining Reclamation Act and the Rules initiate <br />from this date of filing. <br />The Pittsburg & Midway Coal Mining Co. proposes to continue Surface coal mining and/or reclamation operations <br />on land located approximately 5 miles Northwest of Oak Creek, Colorado. The permit area is further described as <br />follows: <br />TSN, R85 W, Portions of Sections 3 t, 32 <br />TSN, R86W, Portions of Section 36 <br />T4N, R86W, Portions of Sections 12, 13, 14, 23, 24, 25 <br />T4N, R85 W, Portions of Sections 7, 8, 17, 18, 19, 29, 30 <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Cow Creek, and <br />Rattlesnake Butte. <br />This application is for renewal of a valid existing permit. <br />The permit is in permanent cessation. The renewal is for continued reclamation. There is no disturbance proposed <br />for undisturbed, or reclaimed, lands. <br />However, we are requesting your agency's evaluation of the potential for impacts to threatened or endangered <br />species of plants or animals, or wildlife species otherwise protected by federal law. In order for us to approve this <br />renewal, we are required to make a finding that "the activities would not affect the continued existence of <br />endangered or threatened species or result in the destruction or adverse modification of their critical habitats as <br />determined under the Endangered Species Act of 1973...." We request your review and recommendation <br />pursuant to this finding.
