Because there is no description of the proposed action or <br />habitats to be affected by the action, we are not currently in a position to offer any assessment of <br />potential impacts that may result from the proposed action. At this time, all we can provide is a list <br />of the federally protected, proposed, and candidate species of concern that could occur in the general <br />project area and which could, therefore, be affected by project actions. Because we do not have <br />mforma4on on affected habitats, the following list will be necessarily inclusive of those species that <br />may be found in any habitats that could be present in western Las Animas County: <br />Mammals: <br />Black-footed ferret (Mzzstela nigripes) Federally listed endangeyed <br />Black-tailed prairie dog (Cvnonrvs ludovicinnus) Candidate for Federal listing <br />Birds: <br />Bald eagle (HaGaeetns leucocephalus) Federally listed threatened <br />Mexican Spotted Uwl (5'rrrz oecrdentalrs lrtcida) Federally listed tiu-eatened <br />Mountain plover (C'{zarndrir4s mnntanus) Proposed federally listed threatened <br />Fish: <br />Arkansas Darter (Etheosrorrra craginz) Candidate for Federal listing <br />Be aware also that Golden eagles and their nests are protected under the Bald and Golden Eagle <br />Protection act; and most bird species are federally protected under the Migratory Bird <br />Treaty Act. Because so many other wildlife species will be affected by large-scale coal mining <br />operations, consultation widr and recommendations of the Colorado Division of Wildlife are also <br />important in planning the conditions for [his permit and its reclamation obligations. <br />
