Box 338 Ronald w.cattany <br />Cotopaxi, CO. 81223 Division Director <br />Re: Request for a Partial Reduction of the Financial Warranty, Coaldale Quarry, M-1977-247 <br />Deaz Mr. Klco: <br />The Division received your latest letter regazding a reduction of the financial warranty at the <br />Coaldale Quarry. If you recall, my letter dated November 6, 2002, your request for a reduction of <br />the financial warranty must follow the requirements of Rule 4.13. Specifically, your request must <br />include an estimate of the actual cost to reclaim the site (not what G-P budgeted) based on what <br />it would cost an independent contractor to complete reclamation, including unit costs for <br />reclamation activities as appropriate to the operation to comply with the provisions of Section <br />3.1 and the Permit Reclamation Plan. Remember, it is not what the operator plans to do, but what <br />needs to be done according to the approved permit. For instance, if there are disturbed areas that <br />still need to be revegetated, the cost estimate must describe the task in as much detail as possible <br />(eg. size of area, land preparation, seeding method, required mulch and fertilizer, time of <br />planting etc.). Add indirect costs (23%) to the final estimate of all the tasks and submit your <br />request to reduce the existing financial warranty to the amount you determined would cover final <br />reclamation costs. The Division will inspect the site and reevaluate the bond.
