Sherman <br />Executive Director <br />Ronald W. rattany <br />Division Director <br />Natural Resource Trustee <br />The Colorado Division of Reclamation, Mining and Safety (Division) has completed its adequacy <br />review of Bear Coal Company's (BCC) submittal of Minor Revision No. 28 (MR-28) for the Beaz No. <br />3 Mine. MR-28 was submitted as a response to several of the issues brought up in the Division's <br />Permit Renewal No. 5 adequacy review letter dated Mazch 27, 2007. The Division has the following <br />questions and comments: <br />Rule 2.03.6 - Rieht of Entry and Operation Information <br />In the first sentence on revised page 2.03-13, reference is made to two documents in support of <br />BCC's right of entry. Please include a description in this sentence of where these two <br />documents can be found in the permit application. <br />Rule 2.03.8 -Permit Term Information <br />2. On revised page 2.03-14, there is language that reads that the current mining permit will expire <br />in July 2002 and that the permit will be extended to 2012. Since this revised page would be <br />included in the permit application with a newly approved permit, please revise this language to <br />reflect that a new permit has been approved. <br />Rule 2.10.3 - Specific Information Requirements <br />3. Map 1, Surface Ownership Map, was revised to include a green line, part of which is dashed, in <br />the insert of the portal area detail. Please explain what the green line represents. Also, please <br />add an appropriate notation concerning the green line to the map legend. Finally, please explain <br />why the green line does not correspond to the dark blue line.
