Kirkwood is 100% owner, president and director of National <br />King Coal, Inc.. <br />National King Coal, Inc. Is the owner and permittee of the King Coal <br />Mine. <br />The delinquent AML fees referred to have been brought current as of <br />May 17, 1994. <br />Rule 2.04.6 <br />Page 4: There are coal analyses included for both upper and lower <br />seams. This page has been altered slightly for clarification. <br />Rule 2.04.7 <br />1. A "Probable Hydrologic Consequences" section has been drafted and <br />added as Appendix 4(7). <br />2-6. All items referred to in these sections have been changed as per <br />your recommendations. A water right agreement has been added as <br />Appendix 2(7). <br />Rule 2.04.9 <br />Section 2.04.9 will be replaced completely with the new pages included <br />herewith. <br />Maps C-4, C-5 and C-7 have been modified to address your concerns <br />regarding soils delineation, Topsoil Borrow Area location and size, <br />actual area to be reclaimed and final reclaimed topography. <br />With your help, we have determined the actual acreage which are/will <br />be disturbed and the text has been altered where necessary to reflect <br />these changes. <br />Soil samples have been taken and processed by the soils lab at <br />Colorado State University using the parameters listed in your letter. <br />The results are included in the application as part of Appendix 9(4). <br />Rule 2.04.10 <br />Section 2.04.10 will be replaced completely with the new pages <br />included herewith. <br />As you suggested, I contacted the Soil Conservation Service for <br />
