<br />Other than this determination of success of "substitute plant growth material" in lieu of topsoil, <br />the permit is in compliance with Rule 2.05.4(2)(d). <br />Rule 2.05.4(2)(e) Revegetation: Revegetation information is found in the permit from pages <br />517-526. The approved post-mining land use is rangeland. The seed mix planted in November <br />1995 is in agreement with the seed mix defined in Table 1. This seed mix uses species adapted <br />to the area and to the post-mining land use for cattle grazing. <br />The permit states that the seed mix will be broadcast seeded at 25.2 Ibs/acre. The Division <br />(~\ recommended drill seeding over broadcast at the same rate as broadcast. Energy Fuels drill <br />O ~~1sY` seeded the seed mix, however, the 1995 Annual Reclamation report did not confirm the rate of <br />~~,` seeding. Of note, observation of the mine site during the 1996 growing season saw considerable <br />~ Yellow swee[clover throughout the drill rows. Yellow sweetclover was not a component of the <br />seedmix. <br />Revegetation success standards were determined in 1982 between the operator and the Division. <br />Establishment of standards is in agreement with Rule 5.15.7(2)(d)(vi). <br />The vegetation success standards are: <br />Vegetative Cover-25% <br />Vegetative Production=3001b/acre <br />Woody Plant Density=2500 stems/acre <br />These will be achieved at 90% of the standard with a 90% confidence interval. <br />There is also a species diversity success requirement found on page 522. <br />Comment for the Operator: <br />2) Please change page 522 to reflect that the woody plant density standard will be achieved <br />at 90 percent statistical confidence as required by rule 4.15.8(7). <br />Other than comment no. 2, the permit is in compliance with Rules 2.05.4(2)(e) and 4.15. <br />Rule 2.08.5(3)(a)(iv) , 2.05.4(2)(b), and 3.02.2(4). Energy Fuels' reclamation liability estimate <br />may be found on pages 486 - 512a. The total estimated liability is found on page 512a, and <br />reflects the liability associated with reclamation of the mine site in April 1990. The Liability in <br />April 1990 was calculated to he $212,331.00. Considerable reclamation work has completed <br />since then with subsequent phased bond releases granted. A quick reclamation liability history <br />follows: <br />1992: DMG determines that the reclamation liability at the Raton Creek Mine is <br />$213, 638.00 <br />
