BOARD ORDER • • III III'llllllllllll sss Based upon the foregoing Findings of Fact the Mined Land Reclamation Board hereby approves the THECI permit amendment ` request for expansion from 30 to 65 acres contingent upon the following conditions: Condition 1. Blasting & Offsite Impacts - DMG will require that the operator submit within 45 days an application for a technical revision which provides the details of a blasting sLirvey and monitoring program. The blasting survey must define th~~ maximum allowable blast for both air and ground vibration in units of peak particle velocity in which there are no offsite impacts at the Phillip & Colita Smith residence along Tunnel Drive and tY.~e city of Canon City's water treatment plant directly east of the quarry.. The blasting monitoring program must identify the location of all proposed blasting monitors and must ensure the submittzil of all monitoring data to the Division at least quarterly. Condition 2.~ Stormwater Management - DMG will require that~the operator submit within 45 days an application for a technical revision which provides appropriate Stormwater runoff calculations, engineering designs and plans, as well as all necessary approvals for the conveyance of Stormwater from the Tezalc Quarry across Tunnel Drive to the Arkansas River without causing adverse offsite impacts. The revision application must also ensure that all designed structures will be installed and functioning properly no later than March 3i1, 1996. The revision application must include written approvals from the City of Canon City, the Hydraulic Ditch Company, and the Southern Pacific Railroad. Condition 3. The Division will require the operator to n~~tice the objectors and all appropriate parties for each revision to the amended permit and also provide a copy of each revision application for review at the County Clerk & Recorders Office in Can~~n City. Condition 4. The Division will require the operator to Cease & Desist from any disturbance in the amendment are;j until the operator has sucessfully demonstrated complian~~e with conditions 1, 2, and 3, has received approval of an acceptable blasting survey and monitoring program, has received approval of an acceptable plan for safely routing Stormwater offsite to the Arkansas River, and has comple=ed installation of all Stormwater designs, including ditcher, ponds, spillways, culverts, and other structures as necessary. Persons concerned with judicial review of -the provisions of the Order are ` advised to consult C.R.S. 24-4-106.
