BOARD ORDER <br />• • III III'llllllllllll <br />sss <br />Based upon the foregoing Findings of Fact the Mined Land <br />Reclamation Board hereby approves the THECI permit amendment <br />` request for expansion from 30 to 65 acres contingent upon the <br />following conditions: <br />Condition 1. Blasting & Offsite Impacts - DMG will require that <br />the operator submit within 45 days an application for a technical <br />revision which provides the details of a blasting sLirvey and <br />monitoring program. The blasting survey must define th~~ maximum <br />allowable blast for both air and ground vibration in units of peak <br />particle velocity in which there are no offsite impacts at the <br />Phillip & Colita Smith residence along Tunnel Drive and tY.~e city of <br />Canon City's water treatment plant directly east of the quarry.. <br />The blasting monitoring program must identify the location of all <br />proposed blasting monitors and must ensure the submittzil of all <br />monitoring data to the Division at least quarterly. <br />Condition 2.~ Stormwater Management - DMG will require that~the <br />operator submit within 45 days an application for a technical <br />revision which provides appropriate Stormwater runoff calculations, <br />engineering designs and plans, as well as all necessary <br />approvals for the conveyance of Stormwater from the Tezalc <br />Quarry across Tunnel Drive to the Arkansas River without <br />causing adverse offsite impacts. The revision application <br />must also ensure that all designed structures will be <br />installed and functioning properly no later than March 3i1, <br />1996. The revision application must include written <br />approvals from the City of Canon City, the Hydraulic Ditch <br />Company, and the Southern Pacific Railroad. <br />Condition 3. The Division will require the operator to n~~tice the <br />objectors and all appropriate parties for each revision to the <br />amended permit and also provide a copy of each revision application <br />for review at the County Clerk & Recorders Office in Can~~n City. <br />Condition 4. The Division will require the operator to <br />Cease & Desist from any disturbance in the amendment are;j <br />until the operator has sucessfully demonstrated complian~~e <br />with conditions 1, 2, and 3, has received approval of an <br />acceptable blasting survey and monitoring program, has <br />received approval of an acceptable plan for safely routing <br />Stormwater offsite to the Arkansas River, and has comple=ed <br />installation of all Stormwater designs, including ditcher, <br />ponds, spillways, culverts, and other structures as <br />necessary. <br />Persons concerned with judicial review of -the provisions of the Order are ` <br />advised to consult C.R.S. 24-4-106. <br />Dated at Denver this day of <br />MINED LAND RECLAMATION BOARD <br />COLORADO DEPARTMENT OF NATURAL RESOURCES <br />MICHAEL B.
