Reynolds <br />3210 Maple Drive <br />Canon City, CO 81212 <br />The Division of Minerals and Geology ("Division") shall be <br />a party. <br />Other persons who attended the Prehearing Conference will <br />have the opportunity to speak as Interested Persons at the Formal <br />Public Hearing if they wish, but shall not be afforded Party <br />status. <br />III. I88IIE8 TO BE <br />Presentations to the Board shall be strictly limited to the issue <br />of whether the pending application complies with the requirements <br />of the Colorado Mined Land Reclamation Act (34-32-101 ET SEQ., <br />C.R.S. 1973 as amended) and the Rules and Regulations promulgated <br />by the Board. The parties shall limit presentations to the <br />question of whether the pending application should be approved or <br />denied, based on the issues stated below: <br />1. Whether the Applicant has demonstrated that off-sit= areas <br />will not be adversely affected by blasting. <br />2. Whether the mining and reclamation operations, specifically <br />the drainage control plan from the affected areas, will :ninimize <br />disturbances to the prevailing hydrologic balance. <br />3. Whether the Applicant will protect all surface area:a of the <br />affected land so as to effectively control fugitive dust and <br />attendant air pollution. <br />Iv. Pre-Hearinq Order <br />1. File list of witnesses, exhibits and issues by 12:00 noon on <br />October 13, 1995. <br /> <br />
